UPSTATE THEATER COALITION FOR A FAIRGAME INC.'S PURPOSE IS TO RECEIVE CONTRIBUTIONS AND PAY NET PROCEEDS OF SUCH CONTRIBUTIONS OVER TO ORGANIZATIONS THAT ARE DESCRIBED IN SECTION 170(C) OF THE INTERNAL REVENUE CODE AND EXEMPT FROM TAXATION.

UPSTATE THEATER COALITION FOR A FAIRGAME INC. ("FAIRGAME") IS A CONSORTIUM OF 12 VENUES WORKING TOGETHER TO ENSURE THAT UPSTATE NEW YORK CASINOS DO NOT HAVE AN UNFAIR ADVANTAGE WITH BOOKING ENTERTAINMENT. FAIRGAME WORKED WITH THE NEW YORK GOVERNOR'S OFFICE AND THE NEW YORK STATE GAMING COMMISSION TO URGE THE REQUIREMENT OF SPECIFIC AGREEMENTS FOR CASINOS IN THREE UPSTATE NEW YORK REGIONS: THE SOUTHERN TIER, THE CATSKILLS, AND THE CAPITAL REGION. FAIRGAME HAS AGREEMENTS IN PLACE WITH THE FOUR CASINOS IN THESE UPSTATE NEW YORK REGIONS THAT INCLUDE REQUIREMENTS SUCH AS FINANCIAL SUPPORT OF EXISTING VENUES, CAPACITY LIMITS ON VENUE SEATING, AND TALENT-BOOKING EXCLUSIVITY. FAIRGAME RECEIVES CONTRIBUTIONS FROM THESE FOUR CASINOS AND PAYS NET PROCEEDS OF THE CONTRIBUTIONS OVER TO THE 12 VENUES MAKING UP THE FAIRGAME CONSORTIUM. THESE 12 VENUES ARE: PROCTORS, SARATOGA PERFORMING ARTS CENTER, SARATOGA SPRINGS CITY CENTER, PALACE THEATRE, TIMES UNION CENTER, BETHEL WOODS CENTER FOR THE ARTS, TROY SAVINGS BANK MUSIC HALL, BARDAVON, ROCHESTER BROADWAY THEATRE LEAGUE, STATE THEATRE OF ITHACA, CLEMENS CENTER, AND THE FORUM THEATRE.
