THE ASCENSION HEIGHTS DEVELOPMENT AKA "WATERTANK HILL" IS 19 SINGLE FAMILYRESIDENCES BUILT ON A VERY STEEP HILL ON 13.32 ACRES AT THE NORTHEAST CORNER OFBEL AIRE ROAD AND ASCENSION DRIVE IN SAN MATEO. ON OCTOBER 14, 2015 THE SAN MATEOCOUNTY PLANNING COMMISSION APPROVED THE PROJECT BY A VOTE OF 3-2. THE BAYWOOD PARKHOMEOWNERS ASSOCIATION APPEALED THAT RULING TO THE SAN MATEO COUNTY BOARD OFSUPERVISORS, BUT ON FEBRUARY 9, 2016 THE SUPERVISORS DENIED OUR APPEAL AND VOTEDIN FAVOR OF THE DEVELOPMENT.WITH THAT VOTE IN EARLY 2016, THE COUNTY PUSHED THROUGH A 19-HOME PLAN FOR WATERTANK HILL THAT IGNORED THE INPUT OF OVER 450 RESIDENTS.RDWTH FILED A CEQA LAWSUIT AGAINST SAN MATEO COUNTY WITHIN WEEKS OF THE DECISION,ASSERTING THAT THE ANALYSIS WAS INADEQUATE AND GUIDELINES INCORRECTLY APPLIED WHENAPPROVING THE 19-HOME DEVELOPMENT ON WATER TANK HILL. OUR LAWYERS, SHUTE, MIHALY &WEINBERGER, ARE A WELL-KNOWN, LOCAL ENVIRONMENTAL FIRM. THE LAWSUIT HEARING WAS HELD ON DECEMBER 8, 2016 WITH JUDGE GEORGE MIRAM IN THE SUPERIOR COURT OF SAN MATEO COUNTY AND ON JANUARY 20, 2017 THE JUDGE DENIED OUR PETITION AND RULED IN FAVOR OF THE COUNTY.WE FILED FOR AN APPEAL OF THAT DECISION IN MAY 2017 AND THE HEARING WAS HELD ON MAY 8, 2018.LATER THAT MONTH THE APPELLATE COURT OF THE STATE OF CALIFORNIA RULED IN FAVOR OF THE COUNTY BY DENYING OUR APPEAL, AND THE DEVELOPER MAY NOW PROCEED WITH THE PROJECT.
