DIRECT SERVICE - AFGHANISTAN, WEST BANK, NEPAL, TUNISIA, AND MYANMAR: SEE SCHEDULE OIN 2021, THE ILF NAVIGATED INCREASING POLITICAL INSTABILITY, INCREASING CONFLICT, AND THE ONGOING PANDEMIC TO ADVANCE ACCESS TO JUSTICE FOR POOR AND MARGINALIZED PEOPLE AROUND THE WORLD.IN AFGHANISTAN, THE ILF REPRESENTED MORE THAN 4,000 INDIGENT ACCUSED PEOPLE IN 2021. WE CONTINUED TO LEAD ADVOCACY TO SECURE THE RELEASE OF PEOPLE HELD IN DETENTION WHO WERE AT HIGH RISK FOR SERIOUS ILLNESS OR DEATH IN THE EVENT OF COVID-19 INFECTION, SECURING THE RELEASE OF 1,500 PEOPLE FROM DETENTION CENTERS. THE ILF ALSO STRENGTHENED OUR PRACTICE OF QUALITY, HOLISTIC LEGAL AID THROUGH THE REENTRY INITIATIVE, WHICH PROVIDES WOMEN AND GIRLS IN THE CRIMINAL JUSTICE SYSTEM WITH COMPREHENSIVE LEGAL AND NON-LEGAL SUPPORT AFTER THEIR RELEASE. IN THE PERIOD LEADING UP TO THE FALL OF AFGHANISTAN TO THE TALIBAN AND DURING THE WEEKS THAT FOLLOWED, WE MOVED QUICKLY TO ADAPT TO THE CHANGING CONDITIONS, PROTECT OUR STAFF, AND SERVE THE NEEDS OF OUR CLIENTS TO THE BEST OF OUR ABILITY. AFTER THE TALIBAN TAKEOVER, THE ILF HAS REMAINED OPERATIONAL IN AFGHANISTAN AND CONTINUES TO PROVIDE LEGAL AID SERVICES. INCREASING FOOD INSECURITY, LACK OF SHELTER SERVICES FOR WOMEN, AND FEAR OF TALIBAN JUSTICE, HAS LED TO GREATER URGENCY OF NEED FOR LEGAL SERVICES AMONG AFGHANS, AND FROM HUMANITARIAN ORGANIZATIONS.IN PALESTINE, THE ILF REPRESENTED 418 CLIENTS IN 2021. AMONG POSITIVE OUTCOMES, ILF LAWYERS OBTAINED PRETRIAL RELEASE FOR 94 CLIENTS, SUCCESSFULLY DEFENDED CLIENTS IN MORE THAN 150 MEDIATION SESSIONS AND WERE ABLE TO SECURE NON-INCARCERATORY SENTENCES FOR 228 CLIENTS INCLUDING AT LEAST 50 CHILDREN WHO WERE PLACED IN CUSTODY OF THEIR PARENTS RATHER THAN DETENTION CENTERS. IMPORTANTLY, WE WERE ALSO ABLE TO REACH MORE WOMEN IN NEED OF LEGAL AID SERVICES IN 2021. THE NUMBER OF WOMEN'S CASES DOUBLED IN 2021 FROM 2020 AND FROM THIS EXPERIENCE WE FINALIZED A BASELINE ASSESSMENT REPORT ON THE NEEDS OF WOMEN IN CONFLICT WITH THE LAW IN THE WEST BANK. WE ALSO EXPANDED OUR CAPACITY TO PROVIDE HOLISTIC REPRESENTATION BY HIRING OUR FIRST SOCIAL WORKER.IN TUNISIA, THE ILF REPRESENTED 267 CLIENTS IN 2021. AMONG POSITIVE CASE OUTCOMES, WE OBTAINED PRETRIAL RELEASE OF 92 CLIENTS AND SECURED ALTERNATIVES TO INCARCERATION FOR 79 CLIENTS. IN PARTNERSHIP WITH UNICEF, THE ILF ALSO COMPLETED AN ASSESSMENT OF THE AVAILABILITY AND QUALITY OF ACCESS TO LEGAL AID SERVICES FOR CHILDREN IN CONFLICT WITH THE LAW IN KASSERINE AND KAIROUAN AND COMPLETED A YEARLONG LEGAL AID PILOT PROJECT THERE. NOTABLY, IN LESS THAN A YEAR SINCE THE ILF'S KASSERINE AND KAIROUAN OFFICES OPENED, WE PROVIDED LEGAL REPRESENTATION TO 88 CHILDREN: 75 BOYS AND 13 GIRLS IN 173 CASES. 101 CASES HAVE BEEN CONCLUDED DURING THE PILOT PROJECT PERIOD. ILF LAWYERS SECURED 19 DISMISSALS OF CHILDREN'S CASES, 37 MEDIATIONS, AND 19 ALTERNATIVES TO INCARCERATION, 14 OF WHICH INCLUDED SURRENDER TO PARENTS. IN COOPERATION WITH THE ABA RULE OF LAW INITIATIVE, THE ILF DEVELOPED A TRAINING CURRICULUM TO EMPOWER LAWYERS ACROSS THE COUNTRY WITH THE KNOWLEDGE AND TOOLS THEY NEED TO ADVOCATE FOR ALTERNATIVES TO INCARCERATION (ATI) AND FIGHT TO DIVERT VULNERABLE PEOPLE OUT OF THE CRIMINAL JUSTICE SYSTEM. USING THIS CURRICULUM, WE CONDUCTED A TRAINING OF TRAINERS PROGRAM IN ALL EIGHT REGIONS OF TUNISIA. IN MYANMAR, THE ILF REPRESENTED 445 CLIENTS IN 2021. AMONG POSITIVE CASE OUTCOMES, WE OBTAINED PRETRIAL RELEASE OF 117 CLIENTS AND SECURED ALTERNATIVES TO INCARCERATION FOR 50 CLIENTS. THE ILF ALSO PAVED THE WAY FOR POLICE ACCOUNTABILITY WHEN OUR LAWYERS CHALLENGED OUR CLIENT'S ILLEGAL DETENTION BY FILING A PETITION THAT REQUIRED THE POLICE TO APPEAR BEFORE THE HIGH COURT TO EXPLAIN THE REASON THAT HE WAS HELD ILLEGALLY FOR 67-DAYS. OTHER HIGH COURT JUDGES ATTENDED THE HEARING AND EXPRESSED THEIR BELIEF THAT THIS WAS LIKELY THE FIRST HEARING OF THIS KIND TO TAKE PLACE IN MYANMAR. IN ADDITION TO CONTINUING TO PROVIDE LEGAL AID SERVICES FOLLOWING THE FEBRUARY 2021 COUP, THE ILF WORKED TO ENSURE DETAINEES COULD ACCESS BASIC NEEDS, INCLUDING FOOD, MEDICINE, PPE SUPPLIES, AND OTHER NECESSITIES THROUGH COORDINATION WITH HUMANITARIAN AID ORGANIZATIONS. WITH AN INCREASE IN ARRESTS OF THOSE PROTESTING THE MILITARY REGIME, WE ALSO COORDINATED WITH DOZENS OF CONCERNED FAMILIES TO IDENTIFY THE LOCATIONS OF LOVED ONES IN DETENTION. IN NEPAL, THE ILF WORKED WITH OUR LOCAL PARTNER, THE PUBLIC DEFENDER SOCIETY OF NEPAL (PDS-NEPAL) TO REPRESENT 275 CLIENTS AND SECURE THE RELEASE OF 34 CLIENTS IN 2021. THE ILF AND PDS NEPAL PRIORITIZED FIGHTING FOR THE RELEASE OF CHILDREN FROM DETENTION THROUGHOUT THE PANDEMIC. IN THE COURSE OF DOING THIS WORK, PDS-NEPAL AND THE ILF IDENTIFIED SEVERAL CHILDREN WHO WERE ILLEGALLY DETAINED DUE TO THEIR INABILITY TO PAY FINES. PDS-NEPAL AND THE ILF ALSO CONDUCTED A SURVEY OF ALL JUVENILES HELD IN DETENTION ACROSS THE COUNTRY MORE THAN 1,000 CHILDREN. AS A RESULT, PDS-NEPAL IS ARMED WITH DATA HIGHLIGHTING THE UNJUST IMPACT FINES ARE HAVING ON POOR AND MARGINALIZED CHILDREN, AS WELL AS DETAILS ON THE LIVED EXPERIENCES OF CHILDREN DETAINED. THE ILF AND PDS HAVE BEEN FIGHTING FOR, AND SECURING, THE RELEASE OF THESE CHILDREN ON A CASE-BY-CASE BASIS WHILE SIMULTANEOUSLY WORKING TO ADVANCE REFORM AT THE NATIONAL LEVEL TO FACILITATE THE RELEASE OF ALL CHILDREN BEING CRIMINALIZED BECAUSE THEY CANNOT AFFORD TO PAY FINES.

THROUGHOUT 2021, THE ILF CONTINUED TO BUILD THE CAPACITY OF LOCAL LAWYERS TO ENGAGE IN IMPACT LITIGATION THAT CURBS UNLAWFUL AND ARBITRARY ACTIONS OF AUTHORITIES. THIS WORK WAS SUPPORTED BY DAY-TO-DAY, CASE-BY-CASE MENTORING BY 27 INTERNATIONAL FELLOWS, WHO PROVIDED 2,199 HOURS OF MENTORING TO ILF LAWYERS AROUND THE WORLD. MUCH OF THIS WORK HAD TO BE DONE REMOTELY DUE TO ONGOING COVID-19 TRAVEL RESTRICTIONS, THOUGH WE WERE ABLE TO HAVE OUR FIRST IN-PERSON FELLOW SINCE THE PANDEMIC BEGAN TRAVEL TO TUNISIA. THIS INNOVATIVE PROFESSIONAL EXCHANGE HAS TRANSFORMED LOCAL LAWYERS FROM PASSIVE PARTICIPANTS IN THE JUSTICE SYSTEM TO PROACTIVE ADVOCATES FOR THE RIGHTS OF THEIR CLIENTS. IN ADDITION TO THIS WORK, THE ILF HAS CONTINUED TO SHARE EXPERTISE WITH INTERNATIONAL ORGANIZATIONS, GOVERNMENTS, AND LEGAL AID PROVIDERS AROUND THE WORLD.IN 2021, THE ILF LAUNCHED TWO PUBLICATIONS. THE FIRST IS A RESOURCE TITLED PRETRIAL MOTIONS: A PRIMER FOR LEGAL AID LAWYERS. IT PROVIDES PRACTICAL GUIDANCE FOR LEGAL AID LAWYERS AROUND THE WORLD - BASED ON THE ILF'S EXPERIENCE - ON ONE OF THE MOST EFFECTIVE LEGAL TOOLS TO DEFEND FAIR TRIAL RIGHTS FROM THE MOMENT OF ARREST. THE SECOND IS A TECHNICAL GUIDANCE DOCUMENT TITLED "QUALITY CRIMINAL LEGAL PRACTICE AT THE REMAND STAGE IN MYANMAR: A PRIMER." THIS PRIMER TRACES THE LEGAL BASIS FOR REPRESENTATION AT REMAND IN MYANMAR. IT OUTLINES HOW LAWYERS CAN PROVIDE AN EFFECTIVE SERVICE AT THIS STAGE WITH BEST PRACTICES, CASE STUDIES, AND DATA.IN 2021, THE ILF CONTINUED ITS PROJECT TO BUILD THE CAPACITY OF INDONESIA LEGAL AID LAWYERS TO PROVIDE POOR MARGINALIZED, AND VULNERABLE PERSONS ACCUSED OF CRIMES WITH ACCESS TO QUALITY, EFFECTIVE LEGAL REPRESENTATION. THE ILF PARTNERED WITH YAYASAN LEMBAGA BANTUAN HUKUM INDONESIA (YLBHI), THE INDONESIAN LEGAL AID FOUNDATION, TO CONDUCT A SIX-MONTH INTENSIVE MENTORING PROGRAM FOR A DIVERSE GROUP OF LEGAL AID PROVIDERS. IN MONGOLIA, THE ILF DELIVERED AN INTRODUCTORY TRAINING ON THE ROLE OF DEFENSE LAWYERS AND QUALITY LEGAL AID REPRESENTATION TO NEARLY 50 MONGOLIAN PUBLIC DEFENDERS WORKING WITH THE LEGAL AID CENTER OF MONGOLIA. IT PROVIDES PRACTICAL GUIDANCE FOR LEGAL AID LAWYERS AROUND THE WORLD - BASED ON THE ILF'S EXPERIENCE - ON ONE OF THE MOST EFFECTIVE LEGAL TOOLS TO DEFEND FAIR TRIAL RIGHTS FROM THE MOMENT OF ARREST. THE SECOND IS A TECHNICAL GUIDANCE DOCUMENT TITLED "QUALITY CRIMINAL LEGAL PRACTICE AT THE REMAND STAGE IN MYANMAR: A PRIMER." THIS PRIMER TRACES THE LEGAL BASIS FOR REPRESENTATION AT REMAND IN MYANMAR. IT OUTLINES HOW LAWYERS CAN PROVIDE AN EFFECTIVE SERVICE AT THIS STAGE WITH BEST PRACTICES, CASE STUDIES, AND DATA.IN 2021, THE ILF CONTINUED ITS PROJECT TO BUILD THE CAPACITY OF INDONESIA LEGAL AID LAWYERS TO PROVIDE POOR MARGINALIZED, AND VULNERABLE PERSONS ACCUSED OF CRIMES WITH ACCESS TO QUALITY, EFFECTIVE LEGAL REPRESENTATION. THE ILF PARTNERED WITH YAYASAN LEMBAGA BANTUAN HUKUM INDONESIA (YLBHI), THE INDONESIAN LEGAL AID FOUNDATION, TO CONDUCT A SIX-MONTH INTENSIVE MENTORING PROGRAM FOR A DIVERSE GROUP OF LEGAL AID PROVIDERS. IN MONGOLIA, THE ILF DELIVERED AN INTRODUCTORY TRAINING ON THE ROLE OF DEFENSE LAWYERS AND QUALITY LEGAL AID REPRESENTATION TO NEARLY 50 MONGOLIAN PUBLIC DEFENDERS WORKING WITH THE LEGAL AID CENTER OF MONGOLIA. WE ALSO CONTINUED WORK TO CONDUCT AN ASSESSMENT OF THE ETHIOPIAN PUBLIC DEFENDER SYSTEM IN COLLABORATION WITH OUR PRO BONO PARTNERS CRAVATH AND SWAINE & MOORE LLP.
