IN KEEPING WITH WATER FOR FLATHEAD'S FUTURE (WFF) MISSION, WFF JOINED CITIZENS FOR A BETTER FLATHEAD AND UPPER FLATHEAD NEIGHBORHOOD ASSOCIATION IN LATE 2021 IN FILING SUIT AGAINST THE MONTANA DEPARTMENT OF ENVIRONMENTAL QUALITY AND CONTINUE IN 2022 TO SEEK RESOLUTION OF THIS CASE. THIS SUIT IS AGAINST MT DEQ AND OUR CORE LEGAL ARGUMENTS REMAIN THAT DEQ'S ADMINISTRATION OF THE WATER QUALITY ACT AS REGARDS NONDEGRADATION REVIEW OF SUBDIVISIONS SHIELDS ITS PROCESS FROM REQUIRED PUBLIC PARTICIPATION AND THAT DEQ FAILED TO PERFORM AN ADEQUATE NONDEGRADATION REVIEW, INCLUDING CUMULATIVE IMPACTS ANALYSIS IN APPROVING THE BENCHES SUBDIVISION OUTSIDE OF COLUMBIA FALLS, MT. DURING 2022 WFF HAS BEEN MONITORING FLATHEAD COUNTY'S PROPOSALS TO CREATE A NEW SEPTAGE RECEIVING STATION FOR ALL COUNTY SEPTIC WASTE APPROXIMATELY ONE MILE NORTH OF FLATHEAD LAKE. THERE ARE POTENTIALLY NUMEROUS WATER QUALITY ISSUES WITH THIS RECEIVING STATION AS PROPOSED.
