THE CITIZENS COAL COUNCIL IS A NATIONAL NETWORK THAT ADVOCATES FOR THE FULL ENFORCEMENT OF THE FEDERAL SURFACE MINING CONTROL AND RECLAMATION ACT (SMCRA) AND ITS DELEGATED STATE PROGRAMS. OUR MISSION IS TO INFORM, EMPOWER AND WORK FOR AND WITH COMMUNITIES AFFECTED BY THE MINING, PROCESSING AND USE OF COAL.

IN OUR OFFICE OF SURFACE MINING RECLAMATION AND ENFORCEMENT (OSMRE) WATCH PROGRAM WE CONTINUOUSLY MONITORED EMERGING RULEMAKING OR ACTIONS THAT COULD IMPACT OSMRE'S REGULATORY AUTHORITY. ANY TIME LAWMAKERS PROPOSED LEGISLATION THAT COULD WEAKEN THE SURFACE MINING CONTROL AND RECLAMATION ACT (SMCRA), CCC SWIFTLY INITIATED APPROPRIATE ACTION TO SUPPORT THE AGENCY'S PROTECTION OF COALFIELD COMMUNITIES. WE ADVOCATED FOR COAL- IMPACTED CITIZENS BY FOSTERING AND FACILITATING ONGOING DIALOGUE IN AFFECTED COMMUNITIES AND ENSURING THEIR CONCERNS ARE HEARD BY GOVERNMENT DECISION-MAKERS. CCC COMBINES OUR NETWORK OF LEGAL EXPERTS WITH THE PEOPLE'S VOICE TO SECURE SUPPORT FOR THE EXISTENCE AND REACH OF THE OSMRE.
CCC CONTACTED PADEP SECRETARY PATRICK MCDONNELL REQUESTING AN ONGOING DIALOGUE WITH PADEP OFFICIALS REGARDING ITS UNDERGROUND MINING PROGRAM. PADEP AGREED TO HOLD ZOOM CALLS WITH CCC STAFF AND EXPERTS AND PROVIDE AN OPPORTUNITY TO ASK QUESTIONS ABOUT THE MINING PROGRAM. CCC & PADEP HIGH RANKING OFFICIALS MET VIRTUALLY FOR AN HOUR A MONTH OVER THE COURSE OF SEVEN MONTHS.
CCC, WITH ASSISTANCE FROM CEISLER MEDIA CONSULTANTS, BEGAN A CAMPAIGN SHORTLY AFTER OUR 2021 REPORT WAS ISSUED TO GARNER SUPPORT FROM PA ENVIRONMENTAL ORGANIZATIONS. WE REQUESTED THE ORGANIZATIONS SUBMIT COMMENTS TO THE PADEP ON ITS ACT 54 5TH FIVE-YEAR REPORT. WITH THE HELP OF THE PENNSYLVANIA ENVIRONMENTAL COUNCIL, CCC WAS ABLE TO SECURE OVER 1,000 COMMENTS TO THE PADEP FROM ORGANIZATIONAL GROUPS AND THEIR MEMBERS.
CITIZENS COAL COUNCIL (CCC) RELEASED OUR COMPREHENSIVE 106-PAGE REPORT ENTITLED "UNDERMINING TRUST: THE COLLAPSE OF ENVIRONMENTAL PROTECTION IN PENNSYLVANIA." THE REPORT DETAILS THE PADEP'S FAILURES TO ENFORCE EXISTING LEGAL RESTRICTIONS ON LONGWALL MINING OPERATIONS IN PENNSYLVANIA. IN COALITION WITH THE SIERRA CLUB AND APPALACHIAN VOICES, CCC FILED A TEN- DAY NOTICE COMPLAINT IN THE UNITED STATES DISTRICT COURT IN DC AGAINST THE ACTING SECRETARY OF THE DEPARTMENT OF INTERIOR. WE ARE CHALLENGING THE NOVEMBER 2020 FINAL ACTION OF DAVID BERNHARDT, THEN-SECRETARY OF THE INTERIOR FOR PROMULGATING FINAL REGULATIONS PURSUANT TO SMCRA OF 1977 CALLED THE TEN-DAY NOTICE RULEMAKING. THE SECRETARY'S RULEMAKING ARBITRARILY, CAPRICIOUSLY, AND UNLAWFULLY MODIFIED IMPORTANT PROVISIONS OF THE SECRETARY'S PRIOR RULES GOVERNING THE TEN-DAY NOTICE PROCESS AND ISSUANCE OF TEN-DAY NOTICES.
