THE ROCKY MOUNTAIN INNOCENCE CENTER (RMIC) WORKS TO PREVENT AND CORRECT THE WRONGFUL CONVICTION OF INNOCENT PEOPLE IN UTAH, NEVADA, AND WYOMING.

PROVIDED FREE LEGAL SERVICES AND EDUCATIONAL PROGRAMS IN UTAH, NEVADA, AND WYOMING. FREE LEGAL SERVICES INCLUDE VOLUNTEER PARTICIPATION BY LAW STUDENTS AND ATTORNEYS IN ALL THREE STATES. THERE WERE TWO FAVORABLE NEVADA SUPREME COURT DECISIONS: 1) THE NEVADA SUPREME COURT MADE A VERY FAVORABLE LEGAL DECISION FOR DNA TESTING IN ONE OF OUR CASES, AND WE LOOK FORWARD TO SUBSTANTIAL, CONTINUED LITIGATION IN THAT CASE. 2) THE NEVADA SUPREME COURT ALSO REMANDED ONE OF OUR CASES FOR AN EVIDENTIARY HEARING BASED ON THEIR INTERPRETATION OF THE RECENTLY ENACTED FACTUAL INNOCENCE STATUTE THAT WE HELPED CREATE IN CONJUNCTION WITH ONE OF OUR EXONEREES. UTAH LEGISLATION - WE WERE A PART OF THE SUCCESSFUL PASSING OF AN EVIDENCE-PRESERVATION BILL THAT TOOK EFFECT THIS SUMMER THAT WILL REQUIRE ALL PHYSICAL EVIDENCE BE PRESERVED FOR THE DURATION OF AN INDIVIDUAL'S INCARCERATION SO THAT POSSIBLE EXCULPATORY EVIDENCE THAT COULD BE OBTAINED THROUGH DNA WILL BE AVAILABLE FOR TESTING. HISTORICALLY, THERE WAS NO OBLIGATION BY STATE AGENCIES OR ACTORS IN CRIMINAL CASES - POST-CONVICTION - TO KEEP THAT EVIDENCE. IN FACT, IT WAS USUALLY DESTROYED, THEREBY PREVENTING WRONGFULLY CONVICTED INDIVIDUALS FROM OBTAINING DNA TESTING TO ESTABLISH THEIR INNOCENCE. RMIC HAD ITS 8TH EXONERATION - MICHAEL THOMPSON IN AUGUST. WE HAD 50 CASES IN ACTIVE LITIGATION OR INVESTIGATION. RMIC GOT A NEW EXECUTIVE DIRECTOR, BOARD PRESIDENT, AND BOARD MEMBERS. WE HELD OUR FIRST IN-PERSON EVENT IN 3 YEARS. AN RMIC CLIENT WAS PAROLED AFTER 28 YEARS INCARCERATION. RMIC STAFF GOT A CLIENT A PAROLE HEARING 5 YEARS EARLY BASED ON HER PLEADING OF INNOCENCE TO THE PAROLE BOARD, AND HIS PAROLE WAS GRANTED AFTER 20 YEARS OF INCARCERATION. ANOTHER CLIENT WAS GRANTED PAROLE AFTER 25 YEARS OF INCARCERATION AFTER RMIC SUCCESSFULLY ADVOCATED ON HER BEHALF TO THE PAROLE BOARD REGARDING THE DISCREDITED SCIENCE THAT WAS THE BASIS OF HER CONVICTION. COVID RESTRICTIONS HAVE BEEN LIFTED SO STAFF CAN DO CLIENT VISITS, WITNESS INTERVIEWS, TRAVEL, ETC.
